Terms and Conditions: Night Farmer Enterprises LLC

1. Agreement to Terms
​
By requesting an estimate, scheduling a service, or authorizing work (via phone, text, email, or in person), the Customer acknowledges and agrees to be bound by these Terms and Conditions in their entirety. Any "Authorization to Proceed" provided by the Customer—including verbal or written directives to "take care of it" or similar—shall constitute a binding contract for the services described and the associated fees.

2. Scope of Work & Change Orders

The services provided by Night Farmer Enterprises LLC are limited to the items specifically listed in the provided quote/estimate. If additional work is requested after the project begins ("Change Orders"), we will provide a price adjustment. Change Orders are typically billed upon completion; however, at our discretion, significant Change Orders (exceeding $500.00) or those requiring specialized material orders may require payment in full before the additional work commences.

3. Deposits, Payments, & Collection

Material Deposits: If the estimated cost of materials exceeds $1,000.00, a 50% deposit of the total project estimate is required before work begins.

Project Deposits: For any project with a total estimate exceeding $2,500.00, a 25% deposit is required before work begins.

Payment Due Date: All final balances are due immediately upon completion of the project unless otherwise specified in writing.

Processing Fees: To maintain competitive pricing, a 4% processing fee applies to all credit or debit card transactions. This fee is waived for payments made via Zelle, Check, or Cash.

Late Fees & Interest: Invoices not paid within 48 hours of project completion are subject to a late fee of $50.00, plus interest at a rate of 1.5% per month on the outstanding balance, unless otherwise agreed in writing.

Right to Lien: Night Farmer Enterprises LLC reserves the right to record a Mechanic’s Lien against the property for any unpaid balances. Client acknowledges that a recorded lien may prevent the sale, transfer, or refinancing of the property until the debt is satisfied in full.

Collection Costs: In the event of non-payment, the Client agrees to pay all costs of collection, including but not limited to court costs, lien filing fees, and reasonable attorney’s fees incurred by Night Farmer Enterprises LLC.

Refund Policy: Deposits are non-refundable once materials have been purchased or work has commenced.

Missed Appointments: If our team arrives during the agreed-upon window but cannot gain access, a $100.00 Service Call fee will be invoiced.
4. Hidden Conditions & Professional Trades

Our quote is based on a visual inspection. If we encounter hidden defects (wood rot, mold, structural issues) or find that interior systems do not meet code, we will pause work. If the required repair exceeds the legal scope of a handyman or requires a licensed specialist, Night Farmer Enterprises LLC reserves the right to stop work until a licensed professional is hired. We will provide a revised estimate for any handyman-level repairs needed to complement that specialist's work.

Manufacturer & Product Defects: Our warranty applies to installation and workmanship only. Night Farmer Enterprises LLC is not responsible for the failure of materials, fixtures, or equipment provided by the client or a third-party manufacturer (e.g., a leaking faucet valve, a faulty LED driver, or a cracked vanity top). Any labor required to diagnose, remove, or replace a defective product after the initial installation will be treated as a new service call and billed at our standard rates.

5. Material Price Volatility
​
Material estimates are valid for 7 days. If material prices increase by more than 10% between the quote date and the project start date, the difference will be billed as a Change Order.
6. Site Access, Safety, & Communication

Access: Client agrees to provide a clear workspace and legal parking within 100 feet of the entrance. Parking fees or permits will be added to the final invoice.

Safety: Pets and children must be kept away from the work area. Night Farmer Enterprises LLC is not responsible for pets that escape during the performance of work. If an unsecured animal creates a safety hazard or prevents work from proceeding, it will be treated as a site readiness failure subject to the Minimum Site Visit Fee ($100.00) as outlined in Section 10.Communication: By engaging our services, you provide express written consent to receive SMS and emails regarding your project (invoices, reminders, etc.). You may opt-out by replying STOP.

Third-Party Contact: Client provides express consent for Night Farmer Enterprises LLC to contact the listing agent, closing attorney, or title company associated with the property to verify payment status or provide notice of outstanding invoices.

7. The "Right to Correct" Guarantee
​
If you discover a defect in craftsmanship, you agree to notify Night Farmer Enterprises LLC in writing within 7 days of project completion. Night Farmer Enterprises LLC shall have the primary right to inspect and correct workmanship errors at no additional cost. You agree not to hire a third-party contractor to repair our work without first providing us a reasonable opportunity to resolve the issue.
8. Lead-Based Paint Acknowledgment

For properties built prior to 1978, the Client acknowledges they have been notified of potential lead-based paint hazards and have access to the digital "Renovate Right" pamphlet. If significant hazards are discovered, work will stop until a certified specialist is consulted at the Client's expense.

9. Job Site Cleanliness

Upon completion, Night Farmer Enterprises LLC will remove all project-related debris and leave the work area in "broom-clean" condition.

10. SUPPLEMENTAL TERMS FOR LARGE PROJECTS & SITE READINESS

Mobilization Deposit: A non-refundable deposit of at least 25% may be required at the discretion of Night Farmer Enterprises LLC to secure a project start date or to fund material procurement. If required, work will not commence until this deposit has cleared.

Milestone Schedule: For larger projects, payments are tied to specific stages of completion. Each milestone invoice is due immediately upon the completion of that phase.

Stop Work Provision: If any progress payment is not received within 24 hours of a milestone being reached, Night Farmer Enterprises LLC reserves the right to immediately suspend all labor. We are not liable for any resulting project delays.

Unforeseen Conditions & Substructure Integrity: If subsurface or latent physical conditions (e.g., structural rot, mold, or degraded framing) are discovered that prevent the safe or proper completion of the estimated task, work will pause. A Minimum Site Visit Fee ($100.00) will be due for the initial mobilization, and a written Change Order must be approved before work resumes on the newly discovered issues.

Site Readiness & Environmental Protocol: To ensure the integrity of materials and the quality of the finish, the client must notify Night Farmer Enterprises prior to the scheduled start time if:

On-site water and electricity are not fully available.

Interior environmental conditions exceed or fall below the required range of 60°F–80°F (essential for proper drywall mud curing and wood calibration).

The work area is not cleared of furniture and personal items.

Failure to provide notification of these conditions prior to our arrival will result in a Minimum Site Visit Fee ($100.00) and the project will be subject to rescheduling.

Substantial Completion: Final payment is due immediately upon "Substantial Completion"—defined as the point where the work area is ready for its intended use or for the next trade to begin.
